These Website Terms of Use ("Website Terms") govern access to filmbuddyapp.com, the early-access waitlist, beta account portal, and related website materials operated by Film Buddy LLC ("Film Buddy," "we," "us," or "our"). They are separate from the Film Buddy App EULA, which governs the macOS application.

By using the website, you agree to these Website Terms. If you do not agree, do not use the website. Nothing in these Website Terms limits rights that cannot lawfully be limited, including mandatory consumer rights.

The current beta is invitation-only and offered only in the United States. It is distributed directly through filmbuddyapp.com using Developer ID and is not distributed through the Mac App Store. The beta is not offered or targeted to users in the European Union or United Kingdom.

1. Eligibility and authority

You must be legally capable of entering this agreement. If you use the website for an organization, you represent that you have authority to bind it. The website is a general-audience service and is not directed to children under 13.

2. Website access and accounts

Film Buddy may change, suspend, or discontinue website or beta-portal features, subject to rights that cannot lawfully be waived. Availability is not guaranteed.

When beta registration is open, account creation requires an access code issued through Film Buddy's admin console. A code may be limited, expire, or be revoked, and possessing one does not guarantee approval or continuing beta access. You must provide accurate information, keep credentials and access codes confidential, and promptly report suspected unauthorized access to hello@filmbuddyapp.com. You are responsible for activity under your account to the extent permitted by law.

3. Acceptable use

You may not use the website to:

  • violate law or another person's privacy, publicity, intellectual-property, contractual, or other rights;
  • probe, scan, or test systems without authorization, bypass an access control, misuse an access code, interfere with service, or introduce malicious code;
  • impersonate another person, submit materially false information, or use automated means to create accounts or overwhelm the service; or
  • scrape, copy, frame, or commercially exploit website content except as law or an express license permits.

These restrictions do not override legally protected security research, interoperability, repair, reverse-engineering, or open-source rights.

4. Film Buddy content and brand

Film Buddy and its licensors retain rights in the website, app, documentation, interface, artwork, wordmark, mascot, and other first-party materials. These Website Terms permit ordinary personal or internal business use of the website; they do not transfer ownership or grant a trademark license. Third-party materials remain subject to their own terms.

5. Your submissions and feedback

You retain rights in information and material you submit. You represent that you have permission to submit it. You grant Film Buddy only the rights needed to receive, store, review, and use the submission for the purpose you requested and as described in the Privacy Policy.

If you voluntarily provide product ideas or feedback, Film Buddy may use them without restriction or compensation, but this does not transfer ownership of your photographs or other pre-existing material and does not override a separate written confidentiality obligation.

6. Waitlist and communications

Joining the waitlist does not guarantee an invitation, release date, feature, price, or continued availability. Requested early-access emails may be stopped at any time by contacting hello@filmbuddyapp.com. Operational account, security, and agreement notices are not marketing and may still be sent when needed to administer the service.

7. App downloads and EULA

An approved beta account may receive a short-lived personal link to the current Mac build. You must affirmatively accept the then-current App EULA before a link is issued. Do not share the link, access code, or gated build. Third-party and open-source terms identified on the Licenses page control for the components they cover.

Beta access is free, with no purchase price or subscription fee. The license continues while the beta program remains available unless ended earlier under the App EULA. No paid sale or checkout occurs during the beta, so payment, tax, cancellation, and refund terms do not apply unless Film Buddy later introduces a paid offer.

Film Buddy LLC makes no VAT-registration or EU/UK trader-status representation for this free, United States-only beta.

The website may link to Apple, camera manufacturers, open-source projects, and other third parties. Film Buddy does not control their services, content, or privacy practices. A link does not imply sponsorship or endorsement.

9. Disclaimers

To the maximum extent permitted by law, the website and beta portal are provided "as is" and "as available." Film Buddy disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement where those disclaimers are lawful. Film Buddy does not guarantee uninterrupted operation, error-free content, beta availability, or that a particular feature will ship. This section does not limit a warranty or remedy that applicable law does not allow Film Buddy to exclude.

10. Limitation of liability

To the maximum extent permitted by law, Film Buddy is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or business opportunity arising from the website. Film Buddy's aggregate liability arising from the website will not exceed the greater of (a) the total amount paid to Film Buddy for the App during the 12 months before the event giving rise to the claim or (b) US $100.

These limits do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable law so provides. Mandatory consumer rights remain unaffected.

11. Suspension and termination

Film Buddy may suspend or terminate access for a material breach, security risk, unlawful conduct, misuse of access codes or downloads, or discontinuation of a beta, with notice when reasonably practicable and legally required. You may stop using the website and request account deletion, subject to records that Film Buddy must retain for security, agreement, or legal reasons.

12. Governing law and disputes

These Website Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, and disputes may be brought in the state courts located in Greene County, Ohio, or the United States District Court for the Southern District of Ohio. This choice is subject to mandatory consumer forums and does not deprive a consumer of mandatory protections or courts available under the law of the consumer's residence.

13. Changes and general terms

Film Buddy may update these Website Terms for future use. The updated version and date will be posted here, and additional notice or renewed agreement will be provided when required. If one provision is unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver. Film Buddy may assign these terms with a business transfer subject to applicable notice and consumer rights.
